Why does the state matter for an eviction notice?
An eviction notice is the first step of a court case, and each state's statute decides what the notice must say, how many days the tenant gets, how those days are counted and how the notice is delivered. A notice with the wrong number of days, a missing statement or a late fee where only rent is allowed can be thrown out, and you start over. That is why this form has no "any state" version: pick the state and the notice is written to its law.
Notice periods by state
| State | Notice | Days | Law |
|---|---|---|---|
| California | 3-day notice to pay rent or quit | 3, not counting weekends and court holidays | CCP § 1161(2) |
| Florida | 3-day notice to pay rent or deliver possession | 3, not counting weekends and court holidays | Fla. Stat. § 83.56(3) |
| Georgia | Notice to vacate or pay all past due charges | 3 business days | O.C.G.A. § 44-7-50 |
| Ohio | Notice to leave the premises | 3 or more before filing | R.C. § 1923.04 |
| Texas | Notice to pay rent or vacate | 3, or the period in the lease | Prop. Code § 24.005 |
Each state has its own page with the details: how to count the days, how to deliver the notice and what to do next.
How to fill out the notice
- Pick the state. The title, the wording and the proof of delivery change to that state's law.
- Enter what is owed. In most states only rent - no late fees or other charges, which can void the notice. Georgia is the exception: its notice covers late fees, utilities and other charges too.
- Enter the dates. The day you deliver the notice and the last day to pay, counted the way your state counts.
Download, sign, deliver it the way your state allows and fill in the proof of delivery at the bottom.
My state is not on the list. What do I use?
This form covers California, Florida, Georgia, Ohio and Texas so far. For another state, do not adapt one of these: the days and the wording differ. Many state and county courts publish their own notice forms on their self-help pages - start there.
What if the property has a federally backed mortgage?
For a "covered dwelling" under the federal CARES Act - a property with a federally backed mortgage or in a federal housing program - the tenant cannot be required to leave before 30 days after a notice to vacate, in any state (15 U.S.C. § 9058(c)). Choose "Yes" in the form and the notice adds that statement.
Is it really free?
