How to fill out an Ohio 3-day notice
- Tenant and rental. Every tenant's name, the rental address with the unit, and the county.
- The reason. The unpaid rent and the period it is for. The notice states nonpayment of rent as the reason you ask the tenant to leave.
- The date. Enter the date the notice is delivered and the date by which the tenant should leave - at least three days later.
The notice prints the warning Ohio law requires, in capitals, so it is conspicuous (Ohio Rev. Code § 1923.04).
Is it a notice to pay or quit?
No. Ohio's notice under § 1923.04 asks the tenant to leave; it is not an offer to stay if they pay.
What does the required warning say?
A landlord's notice to leave a residence must contain, conspicuously: "You are being asked to leave the premises. If you do not leave, an eviction action may be initiated against you. If you are in doubt regarding your legal rights and obligations as a tenant, it is recommended that you seek legal assistance." (§ 1923.04(A)). This form prints it in bold capitals in a box.
How do I deliver it, and when can I file?
Deliver it at least three days before you file the eviction, in one of three ways (§ 1923.04(A)):
- Certified mail, return receipt requested.
- By hand - a written copy to the tenant in person.
- Left at the tenant's home - at their usual place of abode or at the rental.
Some municipal courts count the three days as business days, not counting the day of delivery. Check your court's eviction page or simply allow a few extra days before filing.
What if the property has a federally backed mortgage?
For a "covered dwelling" under the federal CARES Act - a property with a federally backed mortgage or in a federal housing program - the tenant cannot be required to leave before 30 days after a notice to vacate (15 U.S.C. § 9058(c)). Choose "Yes" in the form and the notice adds that statement.
Is it really free?
Yes. No account, no trial and no card: fill in the form and download the PDF. There is no subscription to cancel later. The free PDF carries a small "Made with DittoFox" mark at the bottom of the page.
