How to fill out a roommate agreement
- List everyone on the lease and their share. Two to four roommates, each with a monthly amount; the form adds up the total so you can check it matches the rent in the lease.
- Decide who pays the landlord. Each pays their own share, or one roommate collects the shares by a set day and pays the full rent.
- Agree on daily life, then sign. Utilities, chores, guests, quiet hours and the notice for moving out early. Every roommate signs and keeps a copy.
Does a roommate agreement change the lease?
No. It is an agreement between the roommates only; the landlord is not a party to it and is not bound by it. Many leases signed by several tenants make each of them responsible for the full rent and any damage ("jointly and severally liable"), so if one roommate stops paying, the landlord can still ask the others for the whole amount. The roommate agreement is what lets you get that money back from the roommate who caused the problem.
How should we split the rent?
Equal shares are simplest. If the bedrooms differ - one has its own bathroom, a bigger closet or the parking spot - many roommates split by room size or agree a higher share for the better room. Whatever you choose, write the dollar amounts in the agreement and make sure they add up to the rent in the lease.
What if a roommate moves out early?
The agreement sets a notice period and says the leaving roommate keeps paying their share until a replacement moves in or the lease ends. The replacement must be approved by the remaining roommates and, if the lease requires it, by the landlord - many leases do not allow a new occupant without the landlord's written approval. The leaving roommate also settles their share of bills and of any deposit deductions.
What else should a roommate agreement cover?
Anything that tends to cause fights:
The form includes a simple dispute step: talk first, then a neutral mediator before going to court. Many cities have free community mediation services.
Is it really free?
